1. Policy Overview

At O3GenAI IT Solutions, we are committed to delivering high-quality digital services and ensuring client satisfaction. This Refund Policy outlines the conditions under which refunds may be requested, processed, and granted for our services.

By engaging our services and making a payment, you acknowledge that you have read, understood, and agreed to this Refund Policy in its entirety. This policy forms part of our overall Terms & Conditions.

2. General Principles

2.1 Service-Based Business: O3GenAI IT Solutions provides creative, technical, and marketing services. Because our team dedicates time, expertise, and resources immediately upon commencement of a project, all payments are generally considered non-refundable once work has begun.

2.2 Advance Payments: Advance payments (deposits) are used to secure the team's time and initiate work. These are non-refundable except in the specific circumstances outlined in Section 4.

2.3 Milestone Payments: Payments made upon completion of a milestone are non-refundable, as the agreed deliverable for that milestone has been completed and delivered.

2.4 Monthly Retainer Payments: Monthly retainer fees, once a billing cycle has started, are non-refundable for that cycle.

3. Situations Eligible for a Refund

A full or partial refund may be considered in the following situations:

3.1 Project Not Started: If a Client requests cancellation before any work has commenced and before any resources have been allocated, the advance payment may be refunded in full, minus a 5% administrative processing fee.

3.2 Significant Scope Failure by O3GenAI: If O3GenAI IT Solutions fails to deliver the agreed scope of work in a material way — and the issue cannot be resolved within a reasonable rectification period (typically 7–14 working days) — the Client may be eligible for a partial or full refund of the affected payment.

3.3 Double Payment / Technical Error: If a Client has been accidentally charged twice or an incorrect amount has been debited due to a technical or billing error, a full refund of the excess amount will be processed promptly.

3.4 Service Pause by O3GenAI: If O3GenAI IT Solutions is unable to continue or pauses the project for reasons within our control (unrelated to Client delays or content), a pro-rated refund for the unused portion may be provided.

4. Non-Refundable Situations

Refunds will not be granted in the following circumstances:

• Change of Mind: The Client changes their mind about the service after work has commenced.

• Delayed Client Response: Project delays caused by the Client's failure to provide required content, approvals, credentials, or feedback in a timely manner.

• Dissatisfaction with Subjective Outcomes: Dissatisfaction with creative direction, design aesthetics, or tone of voice where the deliverable meets the agreed brief.

• Third-Party Performance: Dissatisfaction with platform performance (e.g., Meta ad delivery, Google rankings) which is outside O3GenAI's direct control.

• Completed Milestones: Any milestone for which work has been completed and approved by the Client.

• Shooting & Videography Sessions: No refund is available for confirmed photography/videography bookings cancelled less than 48 hours prior to the scheduled session.

• Domain, Hosting & Third-Party Subscriptions: Any costs incurred by O3GenAI on behalf of the Client for third-party services (domains, hosting, plugins, stock assets, ad spends, etc.) are non-refundable.

5. Advertising Spend (Meta Ads, Google Ads)

Advertising budgets (ad spend) paid to Meta, Google, or other platforms are managed by O3GenAI on the Client's behalf. These funds are passed directly to the respective platforms and are entirely outside O3GenAI's control once deployed.

O3GenAI's service fee for campaign management is separate from the ad spend and is governed by the general refund principles above.

Ad spend is non-refundable by O3GenAI. Any refunds of unspent ad budget must be requested directly from the advertising platform (Meta, Google, etc.) in accordance with their respective policies.

6. How to Request a Refund

To initiate a refund request, please follow these steps:

Step 1 — Contact Us: Email info@o3genai.in with the subject line 'Refund Request — [Your Name / Business Name]'. Include your invoice number, the service in question, and a clear explanation of the reason for the request.

Step 2 — Review Period: Our team will review your request within seven (7) working days and may request additional information or propose a resolution (e.g., revised deliverables, scope adjustment) before processing a refund.

Step 3 — Outcome: You will receive a written response via email confirming whether the refund is approved, partially approved, or declined, along with the reasoning.

Step 4 — Processing: Approved refunds will be processed to the original payment method within ten (10) working days of approval. Processing times may vary depending on your bank or payment provider.

7. Dispute Resolution

We encourage Clients to contact us directly before escalating any payment dispute. Most issues can be resolved amicably through open communication.

If a chargeback or payment dispute is filed with a bank or payment provider without first contacting O3GenAI IT Solutions, we reserve the right to suspend all active services and share all relevant documentation with the payment processor to contest the dispute.

Disputes that cannot be resolved directly will be subject to the dispute resolution process outlined in our Terms & Conditions.

8. Amendments to This Policy

O3GenAI IT Solutions reserves the right to update this Refund Policy at any time. Changes will be published on our website with a revised effective date. The version of this policy in effect at the time of your payment governs your refund eligibility.
